1. Agreement to Terms

By accessing or using www.waterproofingcapetown.co.za ("the Website"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Website.

These Terms form a legally binding agreement between you ("you," "your") and Waterproofing Cape Town("we," "us," "our") regarding your use of the Website and the services we offer through it.

2. About Us

Waterproofing Cape Town is a Cape Town–based waterproofing contractor servicing Cape Town and the Northern Suburbs of Cape Town. We provide roof waterproofing, damp proofing, leak repairs, torch-on, flat-roof, balcony, basement, and related waterproofing services.

Our team performs the work directly. We are not a directory, comparison site, or referral platform. Any quote, contract or warranty arising from the Website is between you and Waterproofing Cape Town.

3. Quotes, Inspections and Pricing

3.1 Free inspections

Where we offer a free on-site inspection, the inspection itself is free of charge and creates no obligation to proceed. A written quote follows the inspection.

3.2 Indicative pricing on the Website

Any pricing shown on the Website is indicative only. Final pricing is set in your written quote after we have inspected the site, because waterproofing scope depends on substrate condition, surface area, accessibility, and product spec.

3.3 Quote validity

Unless we state otherwise on the quote, written quotes are valid for 30 days from the date of issue. After that, prices may change with material costs.

4. Booking Work

When you accept a quote, the accepted quote becomes the contract for the work. The contract sets out:

  • Scope of work and materials specified
  • Total price, payment schedule and any deposit required
  • Estimated start and completion dates
  • Warranty period for that specific job

Variations in scope after work has started must be agreed in writing (email or SMS is fine) and may affect the price and timeline.

5. Warranty

Where we offer a workmanship warranty, the exact warranty period and terms are stated on each individual written quote. The warranty covers defects in our workmanship and is conditional on:

  • The waterproofed area being maintained according to our written aftercare instructions.
  • No alterations or repairs to the waterproofed surface being made by other parties without our consent.
  • The original invoice being paid in full.

The warranty does not cover damage from acts of God (e.g. storm damage outside reasonable expectations), structural movement of the building, third-party works, or normal wear and tear beyond the warranty term.

6. Limitation of Liability

Nothing in these Terms limits any liability that cannot be lawfully limited under South African law, including under the Consumer Protection Act 68 of 2008. Subject to that:

  • We are liable only for direct loss caused by our negligent workmanship, up to the value of the original invoice for the affected job.
  • We are not liable for indirect, special or consequential losses such as loss of rental income, loss of profit, business interruption or alternative accommodation costs, except where required by law.
  • We are not liable for pre-existing structural defects or for damage caused by other contractors before, during or after our work.

We carry public liability insurance — a copy of the policy schedule is available on request.

7. Website Use and Content

7.1 Accuracy of information

We try to keep all information on the Website accurate and current, but we make no warranty about the accuracy or completeness of any general information about waterproofing, products or processes published on the Website. The site is for general informational purposes only and is not a substitute for an on-site inspection.

7.2 Website availability

We do not guarantee that the Website will be available without interruption or free from errors. We may modify, suspend or discontinue the Website (or any part of it) at any time without notice.

8. User Conduct

When using the Website, you agree to:

  • Provide accurate information in any form you submit.
  • Not use the Website for any unlawful or fraudulent purpose.
  • Not attempt to gain unauthorised access to any part of the Website or our systems.
  • Not interfere with the Website's operation, including by submitting malware or scraping at a rate that disrupts service.
  • Comply with all applicable laws.

9. Intellectual Property

10. Disputes

If a dispute arises between you and us, we will try to resolve it through good-faith discussion first. If that fails, the dispute may be escalated to mediation before formal legal proceedings are initiated. You retain all your rights under the Consumer Protection Act 68 of 2008, including the right to refer a complaint to the National Consumer Commission or a Consumer Court.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. You agree to submit to the exclusive jurisdiction of the South African courts (specifically the courts seated in the Western Cape) for any dispute arising from these Terms or your use of the Website.

12. Severability

If any provision of these Terms is held to be invalid, illegal or unenforceable, the remaining provisions continue in full force and effect.

13. Changes to These Terms

We may update these Terms from time to time. The current version is always shown here with the "Last updated" date. Continued use of the Website after a change constitutes acceptance of the updated Terms.

14. Consumer Protection Act

Nothing in these Terms is intended to exclude or limit any right you have under the Consumer Protection Act 68 of 2008. If any provision conflicts with that Act, the Act prevails.

15. Entire Agreement

These Terms, together with our Privacy Notice, Disclaimer, and any written quote we provide for a specific job, constitute the entire agreement between you and Waterproofing Cape Townregarding the Website and the services we provide through it.
